Acceptable Use Policy of the Prescott Enterprises, L.L.C. Website

Purpose:
This Acceptable Use Policy ("AUP"), which is incorporated as part of the firm’s website Terms of Service, is intended to ensure the security, reliability, and privacy of the content, computer servers, services, website and other materials (the "System") related to use of this website, its content, products or services. The Magnate Group retains the right to modify this AUP at any time, effective upon posting the modified AUP to this website. It is the website users/viewers responsible for complying at all times with this AUP, as well as with any posted modifications thereto.

Consequences of Unacceptable Use:
The Magnate Group reserves the right to suspend or terminate access to the System upon notice of a violation or attempted violation of this AUP. Indirect or attempted violations of this AUP, and actual or attempted violations by a third party acting on one’s behalf, shall be deemed violations by said user/viewer of this AUP. Furthermore, it is a violation of this AUP to use the services of another company for the purpose of facilitating any of the activities set forth below if such use of another company's service could reasonably be expected to affect the firm’s System in any manner. Security of the System:
Users/viewers are prohibited from violating, or attempting to violate, the security of the firm’s System. Any such violations may result in criminal and civil liabilities upon that user/viewer. The Magnate Group will investigate any alleged violations, and, if a criminal violation is suspected, the firm will cooperate with law enforcement agencies in their investigations. Violations include:
bullet View and use for intended purposes those portions of this website to which we have granted you access;
bullet Tampering, hacking, modifying or otherwise corrupting or breaching security or authentication measures without proper authorization;
bullet Transmitting material that contains viruses or other computer programming routines/engines with the intent or effect of damaging, disrupting or otherwise impairing the computer's functionality or the operation of the System;
bullet Interfering with, intercepting or expropriating any system, data or information;
bullet Use the System in furtherance of any unlawful, harmful, harassing, defamatory, threatening, vulgar, sexually explicit, hateful or otherwise objectionable material of any kind, or any material that exploits children or is invasive of another person's rights;
bullet Engage in and encourage conduct that would constitute a fraudulent or other criminal offense or give rise to civil liability for us;
bullet Impersonate any individual/entity, falsely state or otherwise misrepresent your identity in any way;
bullet Engage in deceptive on-line marketing; and/or
bullet Assist or permit any persons in engaging in any of the activities described above.
